- The syllabus is an aspiration, not a roadmap.
- Unless it's specifically called for, generally we don't
need to know concurrences so much. But when there
is a dissent, who wrote it, who joined it, and
what is the main gripe?
- Also, focus on the 4th, 5th, 6th content.
- Beware of blindly citing the WI defense manual.
- Possibly use brief/motion as writing sample after revision
- 1 class will be @ Marcus's house
- Writing assignments:
- Oct. Motion to suppress.
- Fact section from fact pattern; drawn from real
facts.
- Argument section; also on real case.
- Evidentiary hearing will be based on first set of facts,
will happen after class; over 2 days. Think what
information you want to elicit.
- We will go 5, 6, then 4. 4 is the tricky one. 4th is
mostly about what is not protected: what
is allowed into evidence in spite of a violation
(or what is not a violation). The other two are
more positive, in content.
