Rick is charged with second degree sexual assault of a minor, contrary to
§ 948.02(2). He enters an Alford plea, is sentenced to
eight years of confinement plus eight years of extended supervision,
and serves his time. The terms of his extended supervision include
completion of sex offender therapy, can he either maintain his innocence
or remain silent in therapy, or must he profess guilt in order to
avoid revocation? (State ex rel. Tate v. Schwartz, 2002 WI 127,
257 Wis. 2d 240, 654 N.W.2d 438).
Would it be different if his sentence were the result of a plea
agreement? (State v. Carrizales, 191 Wis.2d 85, 528 N.W.2d 29
(Ct. App. 1995)
