Brown v. Board of Education of Topeka II

1955

Venue: SCOTUS

Facts: Same as before-- this is just the remedies phase

Posture: Same as before, also.

Issue: How are we going to accord relief?

Holding: Same as before: reversed.

Rule: Discover and take the steps necesary to admit the parties of these cases to public schools on a racially nondiscriminatory basis, with all deliberate speed.

Reasoning: There are lots of legitimate competing interests at stake here, but constitutional principles can't be allowed to yield simply because there's disagreement. Courts can supervise the school districts.
