Facts: A guy gets agressively panhandled at the bus station. In a robbery sort of way.

Posture: Guilty at a bench trial.

Issue: Three issues. Was the evidence sufficient to establish intent? If there was no extraneous factor proved, did the state prove attempt? Did the state disprove that the defendant voluntarily abandoned?

Holding: There was enough evidence to establish that the victim felt threatened. It certainly seemed like he was demanding money. The state doesn't have to prove the existence of an extraneous factor: that is not an element of attempt. If voluntary abandonment were a defense here, the legislature would have said so, and they did not.
