California v. Hodari D.

1991

Court: US Supreme Court

Facts: Youths flee officers, they chace. Hodari tosses a small rock. They catch Hodari, and it turns out the rock was crack.

Posture: The crack is allowed in at trial, then suppressed on appeal.

Issue: When was Hodari seized? If it was when the officers first yelled at him, then the seizure was illegal (no probable cause)

Holding: Not siezed. The rock is admissible.

Rule: You are not siezed if you don't stop.

Reasoning: Just think abou tit. "Siezed" means something more than just getting yelled at. The crack, therefore, is not the fruit of a seizure.
