Research & Writing 2 : Week of 19 February
Citation
- Court citation rules. Similar to the blue book, but with a
couple of differences.
- The rules as written are clear and good. The examples given
are wrong. Nobody knows why.
- SCR 80.001: you say "WI App 9" instead of "WI Ct. App. 9"
- SCR 80.02: need to have public domain cite, Wis reports cite, AND
North Western Reporter cite.
- SCR 80.02(2): for short cites, pick one of the cite forms and
run with it.
- SCR 80.02(3)(a): these are mistaken if they are short cites.
- Memo: Kellner v. Christian, 539 N.W.2d 685, xxx (Wis. 1995).
- Brief: Kellner v. Christian, 192 Wis.2d 183, 539 N.W. 2d 685 (1995).
- Memo: State v. Meeks, 2003 WI 104, ¶ x, 666 N.W.2d 859, xxx.
(when you pin-cite in a blue book cite, you need to pin cite in both
the public domain and the regional reporter)
- Brief: State v. Meeks, 2003 WI 104, ¶ x, 263 Wis.2d 794,
666 N.W.2d 859.
- Memo: Jones v. Poole, 579 N.W. 2d 739, xxx (Wis Ct. App. 1998).
- Brief: Jones v. Poole, 217 Wis.2d 116, 579 N.W. 2d 739, (Ct. App. 1998).
(Note that here we say "Ct. App." because this is BEFORE public
domain).
- Memo: Hart v. Bennet, 2003 WI Ct. App. 231, ¶ x, 672 N.W.2d 306, xxx.
(see bluebook rule 10 for that "Ct." business)
- Brief: Hart v. Bennet. 2003 WI App 231, ¶ x, 267 Wis.2d 919, 672 N.W.2d
306.
Note: no period after "App" in this stule.
- Note: in the Blue Book, table T1 (p. 238), the WI public domain cite
is wrong in two ways. There's a space after North West. And it
repeats the paragraph after each pin cite, and you only need to
do it once.
- Don't start a sentence with an abbreviation or §.
