Bennis v. Michigan

1996

Court: US Supreme Court

Facts: Mr. Bennis uses the jointly owned car to consort with prostitutes. It is forfeit in the criminal proceeding. Mrs. Bennis is mad: she didn't even know this was going on, but she loses her half of the car!

Posture: Dunno, exactly.

Issue: Can the cops do this?

Holding: Yes.

Rule: We've got a long line of cases saying that an owner's interest in property may be forfeit by the use to which it is put, even though the owner didn't know about it.

Reasoning: None: just stare decisis.

Dicta: Dissent: So, if I smuggle a joint onto an airline, can the cops sieze the plane? If a crook stays in a hotel, can... yadda-yadda.
