Paradine v. Jane

1178

Court: England someplace...

Facts: Jane rented some land. Prince Rupert invades, and can't be kicked out. The tenant fails to pay the rent, because he's had no income.

Posture: Suit to evict the tenant (sort of moot, since he's evicted by Rupert)

Issue: Does the tenant have to pay rent, even though the property is inaccessible?

Holding: Yes.

Rule: Form: should have pled that the enemy were all German.

Reasoning: Not much. We favor landlords, basically.
