Teton County v. Crow

2003

Court: WY Supreme Court

Facts: The crows buy a four lots in a very nice area, and leave three in their natural state. On the fourth they build a house within the zoning square-footage limits, and have it inspected. Then they remodel, expanding the inside square footage. The county seeks to have it undone.

Posture: Suit seeks the removal of the offending construction, plus $750/day of violation. Initial court finds this unconstitutional. Appeal.

Issue: Does this zoning requirement represent an infringement on constitutional rights?

Holding: No.

Rule: There's a rational basis here.

Reasoning: This is very nice area, so it is rational to limit development. There are no suspect criteria here, so rational basis is enough.
