- are nursing homes and criminals analogous (ante/post), and
does this undermine the "restorative" character?
- are there some things for which restorative works better
- is this justice or prevention? seems like more than just
justice: safety/CMM.
- who manages these conferences and moderates them?
- TX DA Ronny Earl: "re-weaving the community" as the mission of
the DA.
- Considering restorative justice as part of the criminal
defense: is it plausible, would it help (not just the
legal proceeding, but the client's interests overall)?
Maybe late in the case, or after the fact, also.
- Just because an apology is self-serving doesn't mean it's
worthless: there might still be benefit there.
- Even if restorative justice isn't a substitute for the
regular justice system, that doesn't mean it's worthless
either: it can make a difference at least some of the
time.
- Non-custodial compliance programs: in-program offending is
a big warning sign.
