Prior to presentation, present 3 items in writing:
- An edited version of the lower court's opinion
(down to 2 pages or so); can maybe leave out
issues, as long as you don't drop the one that
caused the court to grant cert. (team-generated)
- A brief (not a full-fledged brief). 2 pages or
so: enable class members to understand the case
and what your side's principal arguments are.
- (the third item is the other party's brief)
Total length should be 5-8 pages; submit by noon Monday
the day before the presentation. Be sure to include the
salient facts-- this may mean going to read other lower
court decisions.
Don't use too much precedent. SCOTUS briefs and cases
tend to be cite-crazy, but we don't need to be. On the
other hand, don't forget the text of the constitution.
